Bid note 1 - TUPE

Bid note 1 sets out further information regarding the potential application of TUPE in respect of the third licence competition. The Commission drew bidders’ attention to this issue in the Statement of Main Principles released in November 2005 by stating: “In the United Kingdom, a change in the ownership of a business or a change in service provider can attract the application of the Transfer of Undertakings Protection of Employment) Regulations 1981 (“TUPE”). Revised TUPE regulations were laid before Parliament in 2005 and came into force on 6 April 2006.
