Clarification Point 32 - Bid Submission Certificate

The Commission would like to draw bidders' attention to clause 5.2(a) of the Bid Submission Certificate at Schedule 4 of the Bid Process Agreement (the 'BPA').  Clause 5.2(a) requires, inter alia, that Bidders

"and [their] representatives and [their] Group and any of [their] respective Related Persons have not done and shall not do at any time any of the following acts:

(a)     communicate to a person other than the Commission the retention or contributions specified in [their] Submission".

For the avoidance of doubt, neither a Bidder nor its Group nor its respective Related Persons should, at any time either before submission of its bid or thereafter, communicate to a person other than the Commission any details of the retention or contributions specified in its Submission.
