Clarification point 33 - Use of intellectual property rights by the Current Operator / new Licensee
As stated in the Invitation to Apply, the Commission will be exercising, and will continue to exercise, its rights under the current licence to acquire further intellectual property for the purposes of operating the Lottery. Detail about this intellectual property is contained in the data room.
During the transition period, up until the new Section 5 Licence takes effect in 2009, a new licensee would be unable to use the IPRs as the Current Operator would still be operating the National Lottery.
After the transition period, where the Commission has concluded assignments for certain Intellectual Property Rights, the Commission will grant a licence to the new Operator in respect of those IP rights that it holds, so that the new Operator will be able to use them.
