Independent Section 6 Strategy

Condition breached

Condition 33 of the Section 5 licence

Description

Following an investigation in June 2004 into Camelot’s compliance with Condition 33 of the Section 5 licence it became apparent that the licensee was failing to maintain or implement a strategy to encourage potential applicants for a licence under Section 6 of the National Lottery etc Act 1993, as was required by the condition.

Background

The licence requires Camelot to review the strategy and submit the results of such a review to the Commission on an annual basis.

Regulatory action

The Commission investigated Camelot’s compliance with the licence condition. It was concluded that the licensee was in breach and this was recorded in December 2004.

Outcome

The Commission recognised that while independent Section 6 applications are rare, Camelot continues to receive a considerable number of lottery related ideas that are not intended to be subject of an independent Section 6 application. Condition 33 has therefore amended so that Camelot is now required to adopt and maintain a strategy covering both types of ideas.
